The Energy Regulatory Office’s Public Information Bulletin[1] has published updated auction rules for obtaining the right to cover the negative balance for electricity generated in offshore wind farms.

In accordance with the wording of the MFW Act[2], valid until November 26, 2025, the President of the Energy Regulatory Office was obliged to establish the Rules for auctions for offshore wind farms no later than six months before the date of their commencement, which the Regulator did on May 27 this year.

On November 27, the Act of October 9, 2025, amending the Act on the promotion of electricity generation in offshore wind farms and certain other acts, entered into force[3]. Pursuant to Article 14 of the amendment to the MFW Act, the President of the Energy Regulatory Office was obliged to update the Rules within 30 days of the amended provisions coming into force.

The published Regulations received a positive opinion from the Minister of Climate and Environment. The updated Regulations take into account, in particular, the changes resulting from the October amendment to the MFW Act and the functionality of the Internet Auction Platform module dedicated to electricity producers in offshore wind farms.
